A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. Around 23:40 on August 24, 2015, the Defendant: “A person who steals a mobile phone” was arrested to a slope I belonging to the Daegu East-gu Police Station, Daegu-dong Police Station upon receipt of a report and arrested him as a flagrant offender of larceny, and was traveling along the patrol vehicle, the Defendant expressed a large voice, such as “I am she believed that I am she would have committed an act of larceny, and I am she would know why I am she would know she she would know she she she she face, and I am she would know she she she she she she face she she she face she she face she face she face she wanted.” The Defendant assaulted the Defendant with the said I slope’s chest and right a part of the said I slope, and the rear her part of the patrol on several occasions.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers in relation to the prevention, suppression and investigation of police officers' crimes.

2. 피고인은 2015. 8. 25. 01:32경 대구 동구 반야월북로 209에 있는 대구동부경찰서 수사과 유치장에서 그 곳 근무 중인 경사 J가 자신을 유치장으로 입감하려 하였다는 이유로 화가나 “씨발! 내가 뭘 잘못했는데! 뭔 큰 죄를 지었다고 이 지랄을 하는데!”라고 큰 소리를 지르고, 이에 위 J 경사가 피고인에게 “여기 다른 유치인들도 많은데 늦은 시간에 이렇게 시끄럽게 하면 안 됩니다. 계속 이러시면 보호실에 들어가야 됩니다.”라고 하자 화가나 “씨발놈아! 어린 게 니는 뭔데!”라는 등 큰소리로 욕설을 하고, 이에 위 J 경사가 피고인을 보호실로 입감하려고 하자 격분하여 발로 보호실 문을 걷어차고, 위 J 경사에게 “이 씨발놈이! 내 니 얼굴하고 이름하고 다 봐 놨다. 이 개새끼야! 내가 나가면 한번 보자.”라고 협박하고, 계속하여 발로 그의 허벅지를 차고, 손으로 위 J 경사를 밀친 다음 다리를 깔고 앉고, 그 옆에서 피고인을 제지하던 위 경찰서 소속 경위 K에게 침을 뱉으면서"야! 이 개새끼야...
