[Defendant A] The defendant A shall be punished by imprisonment with prison labor for one year and six months.
However, the above punishment shall be imposed for a period of two years from the date this judgment became final.
Reasons
Punishment of the crime
No person shall make a false indication of origin or make an indication that may cause confusion as to the origin.
1. 피고인 A 피고인은 광주 서구 매월2로 16에 있는 수협중앙회 광주공판장 잔품처리장(수산물시장)에서 ‘S’을 운영하는 중도매인(T)으로서 그곳을 찾은 소비자들에게 수산물을 판매하는 사람인바, 2011. 1. 1.부터 2014. 1. 23.까지 위 광주공판장에서 시가 약 142,130,150원 상당의 중국산 산낙지 7841.5kg을 구입하여 국산 산낙지와 함께 진열하며 원산지를 '국내산'으로 거짓 표시하거나 원산지를 표시하지 아니함으로써 이를 혼동하게 하여 불특정 소비자들에게 약 203,237,650원 상당에 판매하고, 2013. 1. 3.경부터 2014. 1. 23.경까지 시가 약 13,476,200원 상당의 산낙지 약 681kg을 ‘무안 뻘낙지’로 거짓 표시한 다음 불특정 소비자들에게 약 19,612,800원에 판매하였다.
2. The Defendant: (a) was an intermediate wholesaler (V) operating “U” in the Giju Joint Wholesale Market in the Seo-gu, Seo-gu, Gwangju, Seo-gu, Gwangju; (b) purchased approximately 815 km local products from January 3, 2013 to January 23, 2014; and (c) sold approximately 4,439,820 g of the market price among those of the totaling KRW 4,444.5 km in Korea among those of the totaling KRW 16,151,320 to unspecified consumers by failing to indicate or indicate the origin as “domestic acid”; and (d) selling approximately 6,151,320 won to unspecified consumers by causing confusion.
3. Defendant C is an intermediary wholesaler operating “W” in the Gwangju Joint Wholesale Market, located at the 2th 2th 16th Y of the Seo-gu in Gwangju, Gwangju, and sells fishery products to consumers who found such place. The Defendant is at the said Gwangju Joint Wholesale Market from January 1, 201 to January 23, 2014.
