A defendant shall be punished by imprisonment for two years.

Punishment of the crime

On November 12, 2009, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. at the Seoul Northern District Court (Seoul Northern District Court) and completed the execution of the sentence on April 17, 2010.

1. Fraud;

A. The Defendant jointly committed a crime with C along with C, who was a woman living in a de facto marital relationship, leased a camera at a carmer lease store, and was willing to lend the camera to use money for living expenses, etc. from the pawned Art as security.

At around 13:00 on August 31, 2012, the Defendant, along with C, presented the victim E’s “F” lending store located in Mapo-gu Seoul Metropolitan Government, to the effect that “The above victim is an employee in charge of public relations who is an employee in charge ofG promotion and needs Kamera in order to promote the nation.” On the next day, the Defendant made a false statement with C, stating that “The above victim will pay a fee of KRW 80,000 won per day and return it on the next day.”

However, even if a camera is leased, there was no intention or ability to return it, and the camera was a plan to borrow money by providing it as a security to the pawne.

As above, the Defendant conspired with C, thereby deceiving the said victim, and then, was lent from the said victim the amount of KRW 8 million at the market price of the Kamera, namely, “Famaneman 5Dmar Ⅱ.”

In addition, the Defendant conspired with C, from around that time to early September 2012, 12, by deceiving each victim on 12 occasions in total, as described in the attached Table 1, and borrowed from each victim a total amount of KRW 110,100,000,000,000 from each victim.

B. At around 14:00 on September 3, 2012, the sole criminal defendant made a false statement to the effect that “The above victim shall pay a charge of KRW 60,000 won per day of lending Kamera to the said victim, and return it on the next day.”

However, even if a camera is leased, there was no intention or ability to return it.
