A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 Gohap 16] The Defendant is between the victim C (n, 37 years old), the victim D (n, 34 years old) and the F Age E located in Jeonju-si E in Jeonju-si, and the Defendant was first aware of it.

1. 피해자 C에 대한 강제 추행 피고인은 2017. 8. 23. 00:30 경 위 F 나이트에서 옆 테이블에 앉은 피해자에게 술을 따라 주면서 접근한 후 피해자가 거절함에도 불구하고 “ 노래방에 같이 가자” 고 말하면서 피해자의 왼쪽 팔에 팔짱을 끼고, 피해자를 옆으로 당겨 안으면서 3~4 회에 걸쳐 어깨를 끌어안고, 같은 날 01:20 경 위 행위를 피하여 나이트클럽 밖으로 나와 자신의 쎄라 토 승용차 운전석에 탑승하여 일행인 D를 기다리고 있는 피해자를 따라가 위 승용차의 조수석 뒷좌석에 임의로 승차한 후 “ 노래방에 같이 가자” 고 말하면서 피해자의 팔을 잡아당기고, 손으로 피해자의 오른쪽 귓불과 얼굴을 수회 만져 피해자를 강제로 추행하였다.

2. 피해자 D에 대한 강제 추행 피고인은 제 1 항과 같은 일시, 장소에서 C을 따라 나이트클럽 밖으로 나와 C의 승용차 조수석에 앉아 있던 피해자에게 “ 노래방에 같이 가자” 고 말하면서 손으로 피해자의 어깨를 2~3 회 가량 잡아당기고, 피해자의 왼쪽 귓불과 얼굴을 2회 쓰다듬고 만져 피해자를 강제로 추행하였다.
