1. The Defendant’s KRW 170,000,000 as well as 5% per annum from December 17, 2013 to June 17, 2020 to the Plaintiff.
Reasons
1. Basic facts
A. On May 17, 2005, the Plaintiff: (a) purchased 2,500 square meters in Ulsan-gun E7,250 square meters in F, G, and 375,000,000 (the purchase area of the Plaintiff is 1,000 square meters and the price is 150,000,000 won); and (b) entered into a consulting contract with C to create housing site; (c) concluded a contract with the content that the Plaintiff wishes to create housing site; (d) on June 3, 2005, the Plaintiff paid 20,000,000,000 won in total on the date of the contract deposit; and (e) paid 130,000,000,000 won in remainder on June 3, 2005.
B. After that, as land development and share purchase investment business were no longer conducted under the above consulting contract, the Plaintiff was refunded KRW 50,000,000 out of the previous payment on October 25, 2006, and the remaining amount was not refunded KRW 100,000,000,000 in the name of H on February 20, 2008, the Plaintiff concluded a sales contract with the I Co., Ltd. (a company run by the Si Do Do Do Do Do Do , with the purpose of real estate transaction, site creation, and sale business; hereinafter referred to as "I") within 10,000,000 among the forest and field in Ulsan-gun Special Metropolitan City Do Do 170,000,000 (hereinafter referred to as "J forest") and paid KRW 170,000 in the name of the representative director within 200,000 in the name of 70,000.
C. However, I did not perform the duty under the above sales contract for J forest. Accordingly, when the Plaintiff filed a criminal complaint against D and K through H, the wife. On December 17, 2013, the Defendant: (a) instead of J forest, divided into 26,91 square meters in Ulsan-gun, Ulsan-gun, the Defendant, the Defendant, in lieu of J forest, into 26,91 square meters (3,306 square meters in M forest land, 306 square meters, 6,612 square meters in O forest, 6,612 square meters in P forest, and 3,306 square meters in each of 6,61 square meters in U.S. (hereinafter “instant forest”); and (b) 6,61 square meters in each of the instant forest land (2,00 square meters in each of the instant forest; hereinafter “instant land”).
