Reasons
1. Basic facts
A. The building of single-story located in Daegu-gu, Daegu-gu (hereinafter “instant building”) was owned by E and leased (the trade name of the store: F, G, H, I, and J) by dividing it into five spaces. Defendant B leased “I” stores (the size of 33 square meters; hereinafter “instant stores”) from E and operated new retail businesses.
나. 원고는 E과 사이에 보험기간을 2016. 1. 28.부터 2021. 1. 28.까지로, 보험목적을 이 사건 건물 및 부속주택으로, 보험가입금액을 220,000,000원으로 하는 보험계약을, 위 5개의 점포 중 ‘H’을 운영하는 K와 사이에 보험기간을 2017. 2. 9.부터 2022. 2. 9.까지로, 보험목적 및 보험가입금액을 이 사건 건물 일부(철골조 판넬즙 33㎡, 15,000,000원), 건물 내 수용된 동산 일체(5,000,000원), 건물 내 설치/수용된 시설 및 집기 일체(10,000,000원)로 하고 화재로 인해 1일 이상 점포휴업 시 1일당 5만 원을 보상하는 특약을 포함하는 보험계약을, 위 5개의 점포 중 ‘F’을 운영하는 L와 사이에 보험기간을 2016. 12. 2.부터 2019. 12. 2.까지로, 보험목적 및 보험가입금액을 이 사건 건물 일부(철골조 판넬즙 건물 40㎡, 24,000,000원), 건물 내 수용된 동산 일체(5,000,000원), 건물 내 설치/수용된 시설 및 집기 일체(30,000,000원)로 하고 화재로 인해 1일 이상 점포휴업 시 1일당 5만 원을 보상하는 특약을 포함하는 보험계약을 각 체결하였다.
C. On November 27, 2017, around 14:00, fire occurred within the instant store, and the instant building was destroyed by damage.
Upon request of the Plaintiff, M Co., Ltd. assessed the amount of damages of the instant building, internal movable property, facilities, etc. as KRW 120,715,452, and the Plaintiff assessed the amount of damages of the instant building, internal movable property, facilities, etc. as KRW 87,35,062, KRW 25,262,968, KRW 13,905,141, and KRW 126,523,171 =87,555.
