A defendant shall be punished by imprisonment for not less than eight months.

1. Fraud;

A. On June 26, 2013, the Defendant: (a) at a “E” restaurant operated by the victim D in Daegu Northern-gu, Daegu Northern-gu, (b) around 21:30 on June 26, 2013, the Defendant, despite being provided food and alcoholic beverages, had no intent or ability to pay the amount thereof; (c) by deceiving the victim as if he would pay the amount of food and alcoholic beverages; and (d) by deceiving the victim as if he would pay the amount of food and alcoholic beverages, the Defendant did not pay 34,00 won

Accordingly, the defendant deceivings the victim, thereby acquiring property benefits equivalent to the same amount.

B. On August 10, 2013, the Defendant, at around 05:00, did not pay KRW 12,500 on the food cost by deceiving the victim as if he had had no intent or ability to pay the food cost, even if he had been provided with food and alcoholic beverages.

Accordingly, the defendant deceivings the victim, thereby acquiring property benefits equivalent to the same amount.

2. On August 7, 2013, the Defendant entered a “J” restaurant located in Daegu-gu, Daegu-gu, and carried out one part of a wall with a cash of 150,000 won, Samsung Credit Card 1, Hyundai Credit Card 1, Hyundai Credit Card 1, and a community credit cooperative physical card 1.

Accordingly, the defendant stolen the victim's property.

3. On August 8, 2013, the Defendant attempted to commit fraud: (a) at the “Ncafeteria” operated by the victim M in Daegu Northern-gu L, Daegu-gu L, despite having no intent or ability to pay the price even if he/she was provided with food and alcoholic beverages; (b) the Defendant received orders for one person, two diseases, etc. with a swine country boomed, one person, and two diseases; (c) the Defendant suggested the credit card owned by K, which was the victim, by pretending that the victim was a legitimate right holder, as described in paragraph (2).
