Reasons
Punishment of the crime
1. Defendant A and Defendant B are the volunteers of F of the candidate F of the Do-dong Local Election Ethy nationwide, and Defendant B is the volunteers of the above F and the members of the mobile community, the mobile community providing NAV.
No one shall publish or report the results of a public opinion poll predicted in the support rating of each political party or the elected person in an election that has not been registered on the homepage of the Central Committee for Deliberation on Public Opinion polls from 180 days before the election day to the close thereof
Nevertheless, around May 26, 2014, Defendant A entered the results of the public opinion polls on E-Gun election-related public opinion polls conducted by the staff H of E-Gun, who is a public opinion poll institution, in the summary stating that “(i) 5%, J party 27.5%, F 53%, K 41%, E-Eup F candidate 53.5%, K candidate 39.5%, sample sample sample 1,000, 5/26 results of the public opinion poll,” without being registered on the website of the Central Public Opinion poll Deliberation Committee.
Defendant
A around 10:00 on May 28, 2014, around 10:0, around 10:00, at the street filling site of F, a candidate for the front of the Ma Hospital located in Gangwon L, directed Defendant B to put up the above-mentioned domains on the above-mentioned “G” block, and Defendant B posted the above domains on his own cell phone.
Accordingly, Defendants conspired to publish the results of the public opinion polls which was not registered on the website of the Central Election Process Deliberation Committee.
2. Defendant C is a volunteer of the above candidate F, who set up a “G” screen as specified in paragraph (1).
The defendant, at around 15:00 on May 28, 2014, on the website of the E-Gun Office, using the results of the public opinion polls specified in paragraph (1) that was not registered on the website of the Central Election Public Opinion Opinion Deliberation Committee at the defendant's office located in Gangwon N.
