1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. The plaintiff entered the Army on September 22, 1979 and was discharged from military service on July 8, 1982.

B. On June 26, 2014, the Plaintiff asserted that the Defendant was deprived of post-operation after an operation at a military hospital due to the type of expenses incurred during military service, and that the Defendant applied for registration of persons who rendered distinguished services to the State by stating the difference in the application as “coin” (hereinafter “instant difference”).

C. Accordingly, the Defendant suffered the instant wounds during the performance of military duties or education and training following the deliberation of the Board of Patriots and Veterans Entitlement.

On January 26, 2015, the Plaintiff determined on January 26, 2015 as not constituting a person eligible for veteran’s compensation under the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Service to the State and Support for Persons Eligible for Veteran’s Compensation, and notified the Plaintiff thereof.

2. Whether each of the dispositions of this case is legitimate

가. 원고의 주장 1981년 야외 동계훈련 중 야간 경계근무를 서던 부대원이 숙영을 위하여 텐트 입구 쪽에 세워둔 소총을 건드려 소총이 넘어지면서 원고의 코와 미간에 떨어지는 바람에 원고는 코와 미간을 꿰매어야 하는 큰 부상을 입었다.

그런데 원고는 병원으로 이송되지 않은 채 코와 미간을 대충 꿰맨 상태로 혹한기 훈련을 받았다.
