A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 19, 2013, at around 05:00, the Defendant: (a) taken off the victim E, who became aware of in the neighboring age club at a 202 room of “D hotel” located in Seocheon-gu, Seocheon-gu, Seocheon-si; and (b) taken off the victim’s wall, using the gap in which the victim was able to breathly, she taken off the modern card and one national physical check from the victim’s wall; and (c) cut off the victim’s wall by taking advantage of the gap in which he was able to breathly.

2. Fraud and violation of the Specialized Credit Finance Business Act;

A. On December 19, 2013, the Defendant, at around 05:13, decided to pay for the costs of purchasing tobacco at a nearby convenience store by means of credit card instead of paying for the costs of purchasing tobacco at the neighboring convenience store, on the recommendation of the head of Si/Gun/Gu from the end of the 7th floor of the building, “G” located on the 7th floor of the building in front of the building in Bupyeong-si, Seocheon-gu.

On December 19, 2013, at around 05:17, the Defendant paid the amount of tobacco equivalent to KRW 170,000 from the “J” convenience store operated by the victim I on the first floor of the H building in Bupyeong-gu, Seocheon-gu, Seocheon-gu, Seoul, and presented the stolen victim E’s modern card as stated in the above paragraph (1) as if he was a legitimate holder, and then used the stolen credit card by allowing employees K to pay the price, and thereby, exempted them from paying the total amount of KRW 170,000,000 for the goods.

B. On December 19, 2013, around 06:18, the Defendant paid KRW 200,000,000 for marina business establishment, “M” under the “M” under the “M” under the “M” under the “M” under the “M” under the “M” under the “M” under the “M” under the foregoing paragraph, and presented the completion of the modern card of the stolen victim E as if he was the lawful holder, and thereby, acquired pecuniary benefits equivalent to the above amount by allowing N employees of the above business establishment to pay the price, and thereby avoiding the payment of KRW 20,000,000,000,000,000.
