Defendant shall be punished by a fine of KRW 4,000,000.

Where the defendant does not pay the above fine, 100,000 won shall be one day.

Punishment of the crime

[Basic Facts] D is a person who is in office as the representative of the corporation in charge of the business of preventing environmental pollution, etc., and F works as the representative of the corporation in charge of the business of collecting and transporting wastes.

On January 2016, Asan City planned the daily waste collection and transportation and the entrusted private project for cleaning street surface (hereinafter “instant project”) with the content that the daily waste collection and transportation and the cleaning of street surface are entrusted to the new business by dividing the daily waste and street surface into the daily waste and the daily waste collection and transportation, and around May 20, 2016, the method of bidding for the entrustment of the said project was determined and publicly announced as “a contract under negotiation.”

Accordingly, five business entities, including FG, have submitted a bid document and a technical capability evaluation project proposal to Asan City around that time.

On June 7, 2016, Asan City decided to select an evaluation committee member to evaluate the project proposal submitted by the above companies on or around June 7, 2016, and received the recruitment of a candidate for the project proposal evaluation committee member from June 7, 2016 to the around June 20 of the same month.

On June 29, 2016, Asan City selected seven members of its own evaluation committee on or around the same month, and had the evaluation committee evaluate the project proposal on or around the 30th of the same month, and as a result, it was selected as a successful bidder of the GG which obtained the highest score.
