Punishment of the crime

[criminal history] On February 18, 2009, the Defendant was sentenced to one year and six months of imprisonment for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Western District Court, and on May 13, 2011, the Defendant was sentenced to two years of imprisonment for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Southern District Court; on June 24, 2016, the Defendant was sentenced to three years of imprisonment for a crime of habitual intrusion to a structure at night at night; on November 29, 2016, the Defendant was sentenced to eight months of imprisonment with prison labor for a structure at night, and the execution of the sentence was terminated on July 3, 2017.

[Criminal facts]

1. On July 7, 2017, the Defendant invaded into “D” located in “F” operated by the victim E on the fourth floor and opened a small credit cooperative and takes 91,000 won in cash owned by the victim, using the keyss located in “F” store operated by the victim E on the fourth floor.

L. A. L. theft was committed.

2. On July 11, 2017, around 00:41, the Defendant invaded into “H” located in Seocheon-si, Seocheon-si, by means of emergency stairs, intended to hold a small credit cooperative located in the 6th floor in the “J” store operated by the victim I and to steal cash, but the Defendant did not commit an attempted act because the said small credit cooperative was diving.

3. On July 11, 2017, around 00:47, the Defendant intruded into the pllet set forth in paragraph (2) and stolen, as above, one of the small keys of a credit cooperative with which the market price, which was the victim’s possession, was unknown at the “L store operated by the victim K on the sixth floor.”

4. On July 11, 2017, around 00:52, the Defendant intruded into the Dolet specified in paragraph (2) and attempted to hold a small credit cooperative in the “N” store operated by the victim M on the sixth floor and to steal cash, but the Defendant did not commit an attempted attempt due to the said small credit cooperative’s locking.
