Reasons
Punishment of the crime

The accused committed the following crimes under the conditions that the accused lacks the ability to discern things or make decisions due to shocking and disturbance, etc.:
1. Fraud and violation of the Specialized Credit Finance Business Act;
A. On February 2, 2013, around 14:17, the Defendant: (a) put a gasoline into a verification color car with no identification of numbers in D gas stations located in Gangnam-si, Gangnam-si; (b) deceiving the victim E, an employee of the said gas station, by suggesting that the Defendant is a legitimate holder of credit card; (c) by deceiving the victim by suggesting that the Defendant is a legitimate holder of credit card, the Defendant was provided with gasoline amounting to KRW 28,00,000 at the market price; (d) signed on the sales slip prepared by the victim; and (e) using the stolen credit card by delivering it to the victim.
B. On February 2, 2013, at around 14:39, the Defendant: (a) informed the victim H of the “I” operated by Gangwon-si G by the said method in the “I” bank; (b) informed the victim of the said method; (c) received 18K gold bars equivalent to the market price of KRW 810,000 from the victim; and (d) used the credit card stolen by the said method.
2. Violation of the Road Traffic Act;
A. On January 15, 2013, the Defendant driven approximately 300 KK at around the time of granting a low-income motor vehicle without a driver’s license, where the number of which is unknown, the Defendant driven a car around 782 m30 K in the vicinity of the Gangwon-gu Seog-si, Seogwon-si.
