1. 피고인들 피고인들은 2014. 6. 20. 12:50경 강원 정선군 D에 있는 E 식당에서 술을 마시던 중, 평소 피고인들과 친분이 있던 위 식당 종업원 F이 또 다른 식당 종업원인 피해자 G(여, 56세)과 사이가 좋지 않은 것을 알고, 피고인 A은 피해자에게 “왜 텃새를 부리냐, 씨발년이 여기서 일하는 우리 언니(F)를 힘들게 한다”라고 말하면서 피해자의 얼굴 부위에 멸치를 집어던지고, 피해자에게 지속적으로 시비를 걸며 머리채를 잡아당겼으며, 손으로 피해자의 얼굴 부위를 때리고, 피고인 B는 이에 가담하여 손으로 피해자의 얼굴 부위를 때리고, 피해자가 바닥에 쓰러지자 피고인 A은 발로 피해자를 수회 밟고 피고인 B는 손으로 피해자를 수회 내려쳤다.
