A defendant shall be punished by imprisonment for three years.

Criminal facts

The Defendant entered the Republic of Korea around April 2018 with Vietnam, and is a foreign student enrolled in the Korean Language Institute of E University located in Seoul D until now.

이후 피고인은 같은 날 02:50 경 위 편의점 앞 노상에서, 위와 같이 피고인 거주의 기숙사로 도망쳤다가 분한 마음에 피해자를 죽이기로 마음먹고 식칼( 전체 길이 34cm , 칼날 길이 23cm ) 을 허리춤에 넣고 요리용 가위( 총길이 약 20cm )를 바지 주머니에 넣은 후 재차 그곳을 찾아간 다음 다른 일행들과 술을 마시고 있는 피해자에게 다가간 후 오른손에 식칼을 쥐고 피해자를 향해 휘두르다가 이에 저항하는 피해자와 함께 땅바닥에 뒹구는 등 몸싸움이 일었고 이런 와중에 오른손에 쥐고 있는 식칼로 피해자의 오른쪽 눈 부위, 목 뒷부분, 오른쪽 어깨, 왼쪽 팔목 등을 수회 찔러 피해자에게 오른쪽 눈 부위가 4cm 가량 찢어지는 등의 상해를 입힌 후 옆에 있던 피해자의 일행에 의해 제지 당했다.
