Defendant

A, B, and D shall be punished by a fine of KRW 700,000, and Defendant C shall be punished by a fine of KRW 1,000,00.

Punishment of the crime

Defendant

A, B, and D are female members of the candidates M who were sent to the election of the Gohap-gun Council members (F'F's constituency) implemented on June 4, 2014 (F's constituency) and who reside in the adjoining area of M. The Defendant C is a person who resides in the above M.

No person shall make a false report on a resident registration with the intention of casting the vote in a specific election district from 180 days before the record date for the preparation of the electoral registry to the day when the preparation of the electoral registry expires,

1. On January 2014, Defendants A, B, and C conspired to move-in to the address of Defendant C residing in the M election district, for the purpose of winning the election of M, which was going to the election of members of the Gohap-gun National Assembly in the Nancheon-gun National Assembly. The Defendants conspired to move-in to the domicile of Defendant C, who is the child of Defendant A, P, and Q Q, who is the child of Defendant B, and R, to vote for the said M.

Defendant

A and B sent each mobile phone text messages to Defendant C at their own resident registration number and real domicile address to each of their children on January 2014. On January 29, 2014, Defendant C prepared and submitted a move-in report with the purport that the T-Myeon Office located in Gohap-gun S, Chungcheongnam-gun, Seoul will transfer to U.S. for the above O, P, Q, and R.

As a result, the Defendants conspired to make a false report on resident registration for the purpose of casting a vote in a specific election district, and at the same time made a false report on resident registration.

2. Around February 2, 2014, Defendant D requested the submission of a moving-in report to the X residing in the election district of M so that the Defendant and the Defendant’s children can vote in M for the said election at Nancheon-gun Nancheon-gun.

On February 6, 2014, the Defendant prepared and submitted a move-in report to the effect that “the Defendant, V, and W is transferred to the Y of the Gohap-gun, Chungcheongnam-gun, Y through X at the T-Myeon Office located in Gyeongcheon-gun, Chungcheongnam-gun, X.”

Accordingly, the defendant aims to cast a vote in a specific election district.
