1. The Plaintiff:

A. Defendant D is a reinforced concrete structure newly built on the E 229.9m2 above ground in Gwangjin-gu Seoul Special Metropolitan City.

1. Basic facts

A. G newly constructed and completed the fourth floor detached house (hereinafter “victimed building”) on the H ground in Gwangjin-gu Seoul Special Metropolitan City on November 20, 2008, and completed the registration of ownership preservation on December 2, 2008. The Plaintiff purchased the damaged building on September 7, 2009 and completed the registration of ownership transfer on November 16, 2009.

B. On March 9, 2016, Defendant B and C newly constructed an apartment house with the damaged building on the fifth floor and a Class II neighborhood living facility (hereinafter referred to as “family living facility”) on the fifth floor and completed registration of initial ownership on March 16, 2016. Defendant D newly constructed a multi-household house with the fifth floor size E on October 29, 2015 (hereinafter referred to as “family building”) and completed registration of initial ownership on November 16, 2015 after obtaining approval for use on March 9, 2016.

C. From the damaged building, the building 1st Sea is 1.106 m-1.27m on the south side, and the building 2nd Sea is 1.04 m-18m on the south side.

Defendant B and C, without obtaining permission from the competent authority, set up a pole of Aluminium as described in the order on the 4th and 5th floor of Aluminium on the 1st and 5th floor of Aluminium, and completed around April 2016 by constructing a construction project to expand the 4th and 5th floor byground the roof of Alumin position panel (i.e., 20 square meters) (i., 11 square meters) and 44 square meters (i.e., 28 square meters). Defendant D also set up a pole of Aluminium as described in the order on the 4th and 5th floor of Aluminal building without obtaining permission from the competent authority, and completed the construction project to expand the 4th and 5th floor by expanding the 26th and 10th floor of Alumin position panel around November 2015, and completed the construction project around November 2015.
