Reasons
1. Basic facts
A. The Defendant is a council of occupants’ representatives comprised of representatives for each Dong of the Southern-si B Apartment (hereinafter “instant apartment”) and the Plaintiff was elected on May 1, 2016 by the Defendant’s chairperson on June 1, 2016.
B. On June 24, 2016, the Defendant decided to proceed with the instant apartment parking lot, management Dong DaD, etc. (hereinafter “instant construction”) by means of competitive bidding. In accordance with the Guidelines for Selection of Housing Management Operator and Business Entities, where the construction amount exceeds three million won, the Plaintiff entered into a negotiated contract on the instant construction after receiving a written estimate only one business entity, notwithstanding the fact that the Plaintiff could not enter into a negotiated contract.
C. On September 6, 2016, the Defendant’s auditor C announced the temporary opening of the council of occupants’ representatives on the instant apartment on the ground of such unlawful matters, etc.
Accordingly, on September 8, 2016, the council of occupants' representatives held on September 8, 2016 decided to dismiss the plaintiff from the defendant's office by attending four of the seven representative members of the Dong apartment of this case and five election management members.
C On September 9, 2016, the fact that the dismissal resolution against the Plaintiff was announced to the occupants of the instant apartment.
