1. The Seoul Southern District Court B and C (Dual) drafted on January 21, 2016 by the above court with respect to the compulsory auction of real estate.

1. Basic facts

A. On May 2008, the Bank of Korea (hereinafter “Korea Bank”) concluded a loan agreement with D on May 1, 2008, 1, “general loan for loan subjects”, “300 million won per annum, “30 million won per annum,” “200 million won per annum,” “transfer interest rate per annum, 17% per annum, 3 months or more per annum,” “19% per annum,” “17% per annum, and 3 months or more”, “general loan for loan subjects”, “30 million won per annum,” “17% per annum, 3 months or more, and 19% per annum,” “the loan interest rate per annum, 3 months or more”, and “the loan interest rate per annum, 200,000 won per annum, 30,000,000 won per annum, and 50,000,000,000 won per annum (hereinafter “the loan agreement”).

B. Around 2012, our bank’s loan and loan claims against D were assigned in sequence to the Plaintiff. On February 12, 2013, the Plaintiff, who was delegated by our bank with the authority to notify the assignment of claims, notified D of the assignment of claims by content-certified mail and the notification was delivered to D around that time.

C. Upon the Plaintiff’s application, the real estate compulsory auction procedure (this court B) regarding the Guro-gu Seoul Metropolitan Government E-based multi-household (hereinafter “instant real estate”) was commenced on February 26, 2015.

On March 20, 2015, the Defendant prepared a promissory note No. 255,925,000 won for face value (hereinafter referred to as “instant authentic deed”) from Chokon D, and accordingly, on May 11, 2015, upon filing an application for an auction on the instant real estate, the duplicate auction procedure (this court C) commenced on May 12, 2015, and the instant real estate was sold to a third party on November 24, 2015.

(e) An auction court shall be at KRW 338,142,349, the amount to be distributed on the date of distribution on January 21, 2016.
