Defendant shall be punished by a fine of 1.5 million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. Around June 9, 2017, the criminal defendant against the victim B stated, “I will complete the construction of interior works, such as lighting, drawing, and painting work, and pay the price,” to the victim B.

However, in fact, the defendant did not pay the down payment, there was another debt to be changed, and even if there was no certain revenue or property, there was no intention or ability to pay the down payment for the construction work even if the injured party did not have the intention or ability to pay the down payment for the construction work.

Nevertheless, the Defendant deceiving the victim as above and caused the victim to do so from June 10, 2017 to June 24, 2017, but did not pay a total amount of 6 million won for the construction work at the C's main place located in Gyeong-gun, Chungcheongnam-gun, Chungcheongnam-gun, and did not pay the price, thereby acquiring property benefits equivalent to the same amount.

2. Around June 2017, the Defendant against the victim D told the victim D to the effect that “I will accept and open the main points C, but will pay the price after the completion of the installation of the main points by installing the sound equipment necessary for the main points.”

However, in fact, the defendant was unable to pay down payment, there was another debt to be changed, and there was no intention or ability to pay the price even if the damaged person installs a sound device due to the lack of certain income or assets.

Nevertheless, even though Defendant deceiving the victim as above and caused the victim to install a sound device equivalent to KRW 2,850,000 for the total construction cost at C's main place located in Gyeongnam-gun from June 22, 2017 to June 24, 2017, the Defendant did not pay the victim the same amount of monetary benefits.
