1. The Defendants jointly share KRW 343,015,100 with respect to the Plaintiff and the period from May 14, 2016 to July 31, 2018.

Basic Facts

The plaintiff is a company that engages in wholesale and retail business, etc. of functional health foods.

Defendant C was an employee of the Plaintiff, who was in charge of pharmacy business, was dismissed on June 15, 2016.

Defendant B entered the Plaintiff through the introduction of Defendant C with Defendant C’s company type, and was in charge of general business management, sales management, and inventory management, including customer management, and retired from the Plaintiff around November 2015.

The Defendants, while serving as the Plaintiff’s employee, knew that the Plaintiff imported and sold the proteic plastic products “VSL 3” monopoly, established a new company after the Plaintiff’s retirement and supplied VSL Ma3 to the new company. After selling VSL Ma3 at the company’s customer, pharmacy, medicine wholesaler, etc., the Plaintiff’s customer, the same kind of company, and conspired to acquire property benefits.

For this purpose, the Defendants changed the trade name of E, a corporation established with D, which was an officer of the Plaintiff, to F (hereinafter “F”) on November 12, 2014.

Afterward, the Defendants, taking advantage of the Plaintiff’s position in charge of the management of the Plaintiff’s business, sales, and inventory, supplied 57,39,000 won in total from February 9, 2015 to November 19, 2015, 57,39,000 won in the unit price of pharmacy supply (54,850 won per gambling) at around April 10, 2015, including supplying 57,339,00 won to F.

피고들은 2015. 4. 22. 서울 광진구 G, 1층에 있는 F 사무실에서 센트럴팜 주식회사에 원고로부터 염가에 구입한 VSL#3 800박스를 71,760, 000원(단가 박스당 89,700원)에 판매한 것을 비롯하여 2015. 2. 9.경부터 2015. 11. 30.까지 별지Ⅱ ‘(주)F 2015년도 매출현황’ 기재와 같이 총 94회에 걸쳐 VSL#3 7,023박스를 합계 628,245,100원 상당에 판매하였다.

Accordingly, the defendants are 400.40.227,730,000 won and sales amount of 628,245,100 won purchased from the plaintiff.
