1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. D Co., Ltd. (hereinafter “D”)
(2) At the time of establishment D, the Plaintiff and E were appointed as internal directors (the Plaintiff was appointed on January 6, 201), and the Defendant was appointed as internal directors and representative directors (the Plaintiff was appointed on January 6, 201), and the Defendant was appointed as internal directors and representative directors.
After March 21, 2013, E, from the internal director, the defendant resigned from the representative director respectively, and the plaintiff was appointed as the representative director on the same day and is currently in office as the representative director until now.
B. (1) On January 18, 201, the Defendant deposited KRW 200 million into D’s F bank account from that time to November 12, 2013, and deposited KRW 498,465,989 in total as shown in the attached Table with the same account until November 12, 2013. Meanwhile, on the other hand, from the above account, the Defendant deposited KRW 3,250,000 to the Defendant on January 18, 2011, including the withdrawal of KRW 130,93,620, total sum of KRW 130,93,620,00 from D’s corporate bank account until October 15, 2013, the Defendant deposited KRW 5,500,000 from D’s corporate bank account to the Defendant on October 25, 2012, and the deposit was made by the Defendant to the same account as the Defendant deposited on May 37, 2013.
C. On January 30, 2012, the Plaintiff and E have completed two promissory notes with a face value of KRW 50,000,000 at face value (on October 30, 2012 and November 30, 2012), one promissory notes with a face value of KRW 115,00,000 (on December 30, 2012), one copy of the Promissory Notes with a face value of KRW 42,00,000 (on December 30, 2012): A notary public issued with a face value of KRW 30,000 with a face value of KRW 30,000 as an addressee (on December 30, 2012): 30,000 won with a face value of KRW 38,300,000 (on December 30, 200: 30,000 won).
