1. The defendant shall pay to the plaintiff KRW 71,845,681.

2. The costs of the lawsuit are assessed against the defendant.

In light of the overall purport of each statement in Gap evidence Nos. 1 through 4 (including the provisional serial number), the plaintiff shall apply 21% per annum to the defendant on April 16, 2010. The loan amount of KRW 297 million with the defendant on April 16, 2040, interest rate of KRW 6.05% on April 16, 2040, interest rate of KRW 6.05% on loan (base interest rate - 6.05%) where the overdue period of less than one month is less than one month, interest rate of 10% on loan if the overdue period of not less than one month and less than three months, interest rate of 11% on loan if the overdue period of not less than three months exceeds 21% per annum, and 10% per annum from 10.5% per annum on loan to the defendant on April 16, 201, and the defendant shall pay interest rate of KRW 100,000 per annum on loan or 214.

Therefore, the Defendant is obligated to pay to the Plaintiff KRW 71,845,681 as total interest and delay damages on the principal and interest of the loan, which the Plaintiff sought from the Defendant on August 31, 2012, as totaling KRW 316,56,116, as the principal and interest of the loan. Thus, the Plaintiff’s claim is justified.
