A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, as a representative of Donnam-do Donnam-gun C, managed the recruitment and use of his employees, work instructions, safety and health measures, etc., and performed the construction of pumps in F, which is the luminous fish farming farm in Donnam-do E, after being awarded a contract from G.

1. Violation of the Occupational Safety and Health Act;

(a) In order to prevent any danger to workers in the course of performing the work of handling heavy objects, the business owner shall prepare a work plan to prevent any danger, such as falling and falling down in the workplace, electric intensity, narrow landing, etc., and shall perform the work in accordance with such plan;

Nevertheless, around July 5, 2014, the Defendant did not conduct a prior investigation into the workplace while moving pumps from the F-in pumps to the construction site, and did not prepare a work plan regarding safe work methods to prevent the abortion of heavy objects, safety measures measures, etc.

(b) A business owner shall, in cases where he/she engages in any work by assembling a mobile vision, install a safe distance between the safety distresss when he/she is assigned to work at the highest part of the nonmeter;

Nevertheless, around July 23, 2014, the Defendant did not install the safety distress at the highest part of the mobile-type system installed on the part of the engine room at the construction site.

2. A business owner who violates the Occupational Safety and Health Act and dies by occupational negligence shall, in the event of conducting work by using caters, control in advance the workers' access so as not to pass through the cater of the worker's head;

On July 5, 2014, the Defendant, as a manager in charge of pumps in F and at the site of construction sites, did not control workers’ access to the cargo and the bus boom transit route that is being transferred while moving pumps from the above construction site at around 15:30 on July 5, 2014, and did not control workers’ access to the moving route of the mobile boom, which is set off on the vehicle.
