1. Around December, 2013, the Defendant recommended the victim E to join the number system, stating that “Around 200,000 won may be received from the 11-month period if the 10-month period is paid in 200,000,000 won per month,” by calls from the victim E, and by calls from the Manyang-si, the Defendant may receive KRW 22 million from the 11-month period.”

However, in fact, the defendant was false as if he were to join the number system in order to borrow money for a long time from the victim who borrowed money only for a short term, and even if he was paid KRW 2 million per month from the victim, he was willing to join it or use it as funds for guidance and loan in operation, so there was no intention or ability to use it normally with the above number system.

Around January 5, 2013, the Defendant, by deceiving the victim as such, received KRW 2 million from the victim to the Agricultural Cooperative account under the name of the Defendant, from the time to October 7, 2013, a total of KRW 16,000,000 from that time, and was exempted from the Defendant’s liability of KRW 4,00,000,000, as stated in the attached Table 1 List of Crimes.

Accordingly, the defendant, by deceiving the victim, received property and acquired property benefits.

2. On September 20, 2013, the nominal fraud Defendant called, “Around September 2013, 201, 200,000 won, 20 million won, 3 months only, and 3 months, and 3 minutes for interest.”

However, under the circumstance that the Defendant is obliged to pay the amount equivalent to KRW 50 million per month and interest on loans, the Defendant has also been funded by operating the successful bidder and making a loan. However, the Defendant was also in an economic difficult situation, such as receiving cash services due to the smooth inflow of funds, and the amount from the victim is money.
