피고인은 2016. 8. 20. 00:00 경 경주시 C에 있는 ‘D’ 주점에서, 그곳 종업원인 피해자 E( 여, 54) 과 술값에 대해 이야기 하던 중 술값이 많이 나왔다는 이유로 갑자기 욕설을 하며 테이블 위에 있던 맥주병을 들고 피해자 E의 머리를 내리칠 듯이 하면서 발로 피해자 E의 무릎을 걷어차고 이를 피하려는 피해자 E을 따라가 피해자 E의 왼쪽 손목을 잡아당겨 바닥에 넘어뜨린 후 피해자 E의 몸 위에 올라 타 주먹과 발로 피해자 E을 수 회 때리고 걷어차고, 계속하여 그 곳 업주인 피해자 F( 여, 64세) 이 피고인을 말린다는 이유로 주먹과 발로 피해자 F의 전신을 때리고 걷어찼다.
