피고인은 2018. 7. 5. 21:14경 창원시 성산구 B에 있는 C 창원점 1층에서 피고인의 휴대전화 동영상 기능을 켠 채 렌즈를 바깥쪽으로 향하게 하여 손에 들고 다니면서 치마를 입은 피해자 D(가명, 여, 30세)의 뒤로 몰래 다가가 팬티, 허벅지 등 치마 속을 촬영하고, 계속하여 피해자 E(가명, 여, 32세)에게 몰래 다가가 팬티, 허벅지 등 치마 속을 촬영하는 등 별지 범죄일람표 기재와 같이 2018. 3. 31.경부터 2018. 7. 5.경까지 창원 상남동 F, G, H 등지에서 34회에 걸쳐 피해여성 444명의 치마 속 팬티, 엉덩이, 허벅지 등의 신체부위를 몰래 촬영하였다.
