1. The Plaintiff:
A. Defendant A shall complete the payment of KRW 65,487,725 and KRW 49,00,000 among them.
Reasons
1. The Plaintiff: (a) on November 20, 207, extended a loan of KRW 49,00,00 to Defendant A for the duration of the loan to November 20, 2007; (b) on November 20, 2008, the interest rate of KRW 8.5% per annum; and (c) on November 20, 2008, when the maturity of the loan comes, the rate of interest rate of November 20, 2008; (d) on November 20, 2013, the maturity date; (e) on November 20, 2013, the interest rate of the loan of the Defendant A was set as KRW 63,70,000; (e) the interest rate of the loan of this case to November 17, 2015; (e) the interest rate of the loan of this case was set as KRW 8.5% per annum; or (e) the interest rate of overdue interest of the Plaintiff was set as KRW 13739,27,247, and the Plaintiff’s.
Therefore, Defendant A is obligated to pay to the Plaintiff 65,487,725 won (i.e., principal amount of KRW 49,00,000 in arrears and interest interest of KRW 13,739,224 in arrears and interest of KRW 2,748,50 in arrears) from November 18, 2015 to November 17, 2015, the agreed interest rate of KRW 25% per annum for the principal amount of KRW 49,000 in arrears and interest of KRW 13,739,224 in arrears and interest of KRW 2,748,500 in arrears) and the principal amount of KRW 49,00 in installments from November 18, 2015 to the day of full payment. Defendant B is jointly and severally liable with Defendant A to pay KRW 63,70,00
2. Judgment on the defendants' assertion
A. The argument by Defendant A was sold in lots at KRW 125,00,000 from AT Construction Co., Ltd. (hereinafter “AT Construction”) on September 19, 2007, at KRW 125,000, the D 303 of the land surface (hereinafter “instant commercial building”).
The instant loan was a collective loan to pay the remainder of the sales price.
In the first sale contract, the area of the commercial building in this case was 21.984 square meters.
