Text
1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On May 9, 2017, the Plaintiff entered the Republic of Korea as a short-term visit (C-3) status on May 9, 2017, and applied for refugee status to the Defendant on June 5, 2017.
B. On March 16, 2018, the Defendant rendered a decision on the recognition of refugee status on the ground that the Defendant cannot recognize “a sufficiently-founded fear that is likely to be injured” as a requirement of refugee under Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol on the Status of Refugees.
(hereinafter “instant disposition”). C.
The Plaintiff filed an objection with the Minister of Justice on March 23, 2018, but the Minister of Justice dismissed the objection on November 29, 2018.
[Ground of recognition] Facts without dispute, Gap evidence 1 through 5, Eul evidence 1 and 2, the purport of the whole pleadings
2. Whether the instant disposition is lawful
A. The plaintiff's assertion was made in Kamera by joining B (B; hereinafter referred to as "B") in Kamera, and was engaged in activities such as publicizing the party and encouraging him/her to join the area of his/her South Western, and on January 21, 2017, the government-affiliated forces in Kamera had found the plaintiff's house and attempted to arrest the plaintiff, and the plaintiff's spouse was assaulted by avoiding it, and the plaintiff's spouse was tried to find the plaintiff's mother's house and to arrest the plaintiff. On November 25, 2017, he/she did not find the plaintiff, but failed to find the plaintiff's wife's wife's body, thereby misunderstanding the plaintiff's spouse as the plaintiff's spouse.
Although there is a well-founded fear that the plaintiff would be stuffed on the grounds of a political opinion from the Kameri Government if the plaintiff returned to Kameri in the present state of designated acceptance in Kameri, the disposition of this case on a different premise must be revoked as unlawful.
B. Determination 1 provides that “Refugees” may be persecutioned on grounds of race, religion, nationality, status as a member of a specific social group or political opinion.
