A The president of a social welfare foundation D, who actually operates “M” registered as the head of H, the head of H, the same military I located, and the head of H, the head of H, and the head of HK located in the same military K located, and Defendant B, the head of the above H facilities, who is a disabled person residing in the foregoing foundation established and operated by the foundation. 1. 피고인들의 공동범행 피고인들은 함께 H을 운영하며 2008년 경부터 입소 장애인들의 자금관리를 하여 준다는 명목으로 위 H 입소 장애인들인 피해자 N, 피해자 O, 피해자 P, 피해자 Q으로부터 ㈜쏘렌드코리아에서 교부하는 임금 및 퇴직금 등이 입금되는 각 농협통장 및 그 입출금에 필요한 서류 일체를 교부받아 이를 위 피해자들을 위하여 보관하던 중, 피해자 O의 농협통장에서 2013. 3. 12. 15,000,000원을 인출한 것을 비롯하여 별지 범죄일람표Ⅰ 기재와 같이 2008. 11. 13.경부터 2014. 4. 24.경까지 현금인출 또는 피해자 명의 적금계좌로 이체 후 사용하는 등의 방법으로 합계 60,070,242원을 인출하고, 피해자 P의 농협통장에서 2010. 4. 6. 5,000,000원을 인출한 것을 비롯하여 별지 범죄일람표Ⅱ 기재와 같이 2008. 11. 13.경부터 2014. 4. 24.경까지 같은 방법으로 합계 60,411,493원을 인출하고, 피해자 N의 농협통장에서 2012. 11. 2.경 6,000,000원을 인출한 것을 비롯하여 별지 범죄일람표Ⅲ 기재와 같이 2009. 5. 30.경부터 2014. 4. 24.경까지 같은 방법으로 합계 62,330,170원을 인출하고, 피해자 Q의 농협통장에서 2013. 3. 12. 1,200,000원을 인출한 것을 비롯하여 별지 범죄일람표Ⅳ 기재와 같이 2013. 1. 3.경부터 2013. 11. 13.경까지 합계 11,666,700원을 인출하여, 피고인들이 운영하는 개인 카페 및 요양원 공사비...
