1. The Defendant’s KRW 49,983,00 for the Plaintiff and KRW 6% per annum from April 4, 2017 to July 20, 2017.
Reasons
The following facts may be acknowledged according to the purport of Gap's evidence 1, 2, and 5, Gap's evidence 3-1 through 6, Gap evidence 4-1, 2, Eul evidence 2-1, 2-2, and Eul evidence 4, and the whole oral argument:
① 원고가 2015. 12. 2. 피고에게 ‘애플힙(Apple Hip)’이라는 골반 및 힙업(Hip up) 교정기의 개발용역을 제공하기로 하는 계약(이하 ‘이 사건 개발계약’이라고 한다)을 체결하였는데, 그 내용은 원고가 피고에게 ‘애플힙 제품 개발, 개발제품 테스트, 설계도면, 승인원, 기타 애플힙 개발에 필요한 업무’를 제공하고, 피고는 용역결과물을 제공받고 원고에게 용역비로 1,500만 원(부가세 별도)을 지급한다.
‘는 것이다. 피고는 2015. 5. 11. 원고에게 위 개발계약에서 정한 계약금 550만 원을 지급하였다. ② 원고가 2015. 12. 말경 애플힙에 들어갈 회로를 설계하고 설계도면을 작성하는 등 애플힙의 개발을 완료해피고의 승인을 받았고, 피고는 2015. 12. 29. 원고에게 용역잔대금 1,100만 원 중 1,000 만 원을 지급하였다. ③ 피고가 그 무렵 ’2016. 4.경부터 홈쇼핑에서 애플힙을 판매할 계획이라며‘ 원고에게 제품의 양산에 필요한 ’금형 제작, 부품 구입과 샘플 제작, 제품 제작‘ 용역까지 맡겼다.
④ On January 20, 2016, the Plaintiff received KRW 15 million from the Defendant, and requested the production of gold paper from “A” to “A”, thereby completing the production of gold paper around February 2016, and produced 30 sets of wood and sampling in accordance with the Defendant’s order.
⑤ On May 25, 2016 and April 3, 2017, the Plaintiff issued a tax invoice with the following content and amount, and the Defendant approved both of them.
(6) On May 25, 2016, 38.5 million won, printed circuit board (PCB) and sampling production 3,795,000 won, and (b) (i) April 3, 2017, 36,575,00 won, imported materials (b) and 1,35,000 won, and 6.36,575,000 won.
