A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
The Defendant is a person who is engaged in driving a non-registered 125c cruise ship.
1. On June 10, 2012, the Defendant violated the Act on Special Cases concerning the Settlement of Traffic Accidents, the Road Traffic Act, the Road Traffic Act (driving without a license) and the Road Traffic Act (driving without a license) and the Defendant was under the influence of alcohol of 0.085% of blood alcohol concentration without obtaining a driver’s license on June 23:25, 2012, driving the said cruise and driving the two-lanes along the speed of about 90 km per hour at the south of Hongcheon-gu, Hongcheon-gu, Hongcheon-gu, Seoul.
At that time, it was night, and the location was about 44 lanes in which signal lights are installed, and therefore, the driver of the motor vehicle had the duty of care to safely proceed in accordance with the new code.
Nevertheless, under the influence of alcohol, the Defendant neglected to do so and was negligent in the red signal in violation of the new code, and was driven by the victim B (the aged 69) who was directly engaged in under the new code to the right side from the left side of the Defendant's running direction of the horse, toward the high side from the front side of the Oran Elementary School, and was driven by the victim B (the aged 69) who was directly driving under the new code.
As a result, the Defendant suffered injury to the frameworks of the Y110 Oral Ba, which is accompanied by a non-alleys (all parts) that require approximately eight weeks of medical treatment, due to such occupational negligence, and at the same time damaged CCA 110 Oral Ba, which is the victim’s ownership, to have a amount equivalent to KRW 810,000 for repairing expenses.
2. The Defendant violated the Guarantee of Automobile Accident Compensation Act: (a) at a section of about 7 km from the date and time as indicated in paragraph (1) to the two-lanes located in Hongcheon-gun, Hongcheon-gun, Hongcheon-do, Hongcheon-do, Hongcheon-do, Hongcheon-do, in front of the restaurant; and (b) the Defendant who did not subscribe to liability insurance.
