1. The Defendant shall pay to the Plaintiff KRW 4,121,198 and the interest rate of KRW 20% per annum from February 14, 2015 to the day of complete payment.

From March 11, 201 to January 30, 2015, the Plaintiff was employed by the Defendant and worked until January 30, 2015, and was not paid KRW 47,602,451 in the aggregate of KRW 8,101,561 and retirement allowances 39,50,890 accrued until retirement. The Defendant did not dispute that the Plaintiff deposited KRW 47,602,451 in order to pay the said wages and retirement allowances with the Plaintiff as the principal deposit on July 21, 2015.

In addition, although the above deposit does not cover all of the above wages, retirement allowances, and damages for delay, the plaintiff recognizes that it is valid as part of payment.

Therefore, pursuant to the order of appropriation under Article 479 of the Civil Act, the amount remaining after being appropriated for the repayment of the above wage, retirement allowance, and delay damages thereof, shall be appropriated for the payment of part of the above wage and retirement allowance. With respect to the above wage and retirement allowance, as the plaintiff seeks, and with respect to the retirement allowance, as to the amount of the above wage and retirement allowance, 4,121,198 won (i.e., 47,602,451 won x 20%) calculated at the rate of 20% per annum as stipulated in the Labor Standards Act from February 14, 2015 to July 21, 2015 (i.e., the date when the defendant retired from office) pursuant to Article 9 of the Guarantee of Workers' Retirement Benefits Act (i.e., 47,602,451 won x 20% x 158 days x 365 days x 158 days / 43,481,

Therefore, the Defendant is obligated to pay the Plaintiff the remaining wages and retirement allowances, the amount of KRW 4,121,198, and damages for delay calculated at the rate of 20% per annum from February 14, 2015 to the date of full payment.

Thus, the plaintiff's claim is accepted within the scope of the above recognition, and the remainder is dismissed as there is no ground.
