1. Defendant L, T, U, V, W, X,Y, Z, AB, AC, M, AD, AE, AE, AF, AG, AP, AP, Q, ATR, ASS, N,O, AU, AH, and AI among the instant lawsuits.
Reasons
1. The gist of the plaintiffs' assertion is that the members of the defendant clan are the members of the defendant clan, and the defendant L et al. are the title trustee or their successors who registered each of the real estate of this case from the defendant clan.
Defendant clan was unable to complete the registration of ownership transfer under the name of Defendant clan with respect to each of the instant real estate corresponding to farmland, and it was impossible to complete the registration of ownership transfer under the name of Defendant clan, etc., but on April 4, 2013, Defendant clan resolved to terminate the title trust agreement entered into with Defendant L, etc. and to trust each of the instant real estate to the Plaintiffs newly.
Therefore, the plaintiffs, on behalf of the defendant clan, implement the registration procedure for transfer of ownership for each share of each of the instant real estate, which was based on the termination of the title trust agreement against the defendant clan, and seek for the implementation of the registration procedure for transfer of ownership under a new title trust agreement for
2. Article 4 of the Act on the Registration of Real Estate under Actual Titleholder’s Name (Effect of Title Trust Agreement) (1) A title trust agreement shall be null and void;
(2) Any change in any real right to real estate made by registration under the title trust agreement shall be null and void.
Articles 8 (Special Cases concerning Class VIII, Spouses, and Religious Organizations) Articles 4 through 7 and 12 (1) through (3) shall not apply where any of the following events occurs and is not involved in evading any tax, evading any compulsory execution, or evading any legal restrictions:
