A defendant shall be punished by a fine of 500,000 won.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

From September 1, 2012 to October 5, 2012, the Defendant: (a) entered the access road to the C apartment complex in thischeon-si; (b) the fact was merely expressed to the purport that D, the representative chairperson of the C apartment occupant, “E Co., Ltd. (E) may transfer apartment management employees to another apartment complex; (c) designated the Defendant as the principal supervisor of the apartment management of the said apartment to another apartment complex; and (d) urged E Co., Ltd. (E) to transfer or dismiss the said apartment complex to another apartment complex; and (e) did not unfairly dismiss the Defendant on the access road to the public, including the aforementioned C apartment resident, despite of the fact that the E Co., Ltd. was abused from office to office, a representative of the C apartment occupant, and the president of the E Co., Ltd., Ltd., the president of the E Co. (E), by posting a serial card stating the false fact that he was dismissed, i.e., the president of the E Co., Ltd., by openly pointing off the demonstration.

1. The illegality of the alleged defendant's assertion falls under the case where there was a considerable reason to believe that the facts stated in the flag card were true and it was solely about the public interest.

In the case of an act that defames another person’s reputation, if it is a matter of public interest and its purpose is solely for the public interest, the act is not unlawful if it is proved that the stated fact is true, and even if it is not proven, if there is a considerable reason to believe that it is true, it is not unlawful. Thus, whether there is a reasonable reason to believe that the alleged fact was true or not is due to the content of the stated fact, the evidence or materials believed to be true or not, the reliability of the fact, and the easiness of fact verification.
