All appeals are dismissed.
Reasons
The grounds of appeal are examined.
1. Examining the reasoning of the lower judgment as to Defendant A’s grounds of appeal in light of the evidence duly admitted by the lower court, we affirm the lower court’s determination that all of the charges of this case against Defendant A (excluding the part on acquittal of the first instance court’s reasoning) are recognized, and it did not err by misapprehending the legal doctrine on the liability of an aiding and abetting offender, contrary to logical and empirical rules.
In addition, under Article 383 subparagraph 4 of the Criminal Procedure Act, only in cases where death penalty, life imprisonment, or imprisonment or imprisonment without prison labor for not less than ten years has been imposed, an appeal on the grounds of unfair sentencing is allowed. Thus, in this case where a more minor sentence has been imposed against Defendant A, the argument that the amount of punishment is unreasonable
2. Examining the grounds of appeal by Defendant B in light of the evidence duly admitted by the first instance court, which maintained the reasoning of the lower judgment, the lower court is acceptable to have determined that all of the facts charged in this case (excluding the part dismissing prosecution) against Defendant B was recognized on the grounds indicated in its reasoning. In so doing, the lower court did not err by misapprehending the legal doctrine as to co-principal by either recognizing facts contrary to logical
3. As to the grounds of appeal on the Defendant B by the public prosecutor, the facts charged should be specified by specifying the time, date, place, and method of the crime (Article 254(4) of the Criminal Procedure Act). In a case where the criminal intent is single and the method of the crime is identical, and each victim’s damage legal interests are independent even if the method of the crime is identical, so it does not constitute a single comprehensive crime, and multiple types of frauds are established independently for each victim, and in such a case, the amount of damage by each victim and each victim can be specified.
