The defendant shall pay to the plaintiff 116,614,080 won and 114,485,004 won among them, per annum from June 26, 2020 to the day of full payment.

1. Determination as to the cause of claim

A. 1) On March 15, 2018, C Co., Ltd. borrowed KRW 158,000,000 from D Co., Ltd. with interest rate of KRW 7.9% per annum, delay damages, 10.9% per annum, and 60 months during repayment period (hereinafter “instant loan”). (hereinafter “instant loan”).

(2) On June 23, 2020, the Defendant transferred the instant loan claim to the Plaintiff on June 23, 2020, and notified C of the said assignment of claim on June 25, 2020.

3) With respect to the instant loan, the principal remaining as of June 25, 2020 shall be 114,485,004 won (158,00,000 won - 43,514,996 won) and interest unpaid shall be 2,058,640 won, and damages for delay shall be 70,436 won. However, according to the facts of the above determination, the Defendant, as a joint guarantor, has the obligation to pay the Plaintiff the remainder of the principal interest, 116,614,080 won (2,05,04 interest rate of 114,48,640 won, 70 damages for delay: 114,485,00 won, 436 won, and damages for delay from June 26, 200 to the date of the final settlement of interest rate of 114,485,004 won, which is the remainder of the principal of the loan.

2. In conclusion, the plaintiff's claim can be accepted, and it is so decided as per Disposition by admitting it.
