1. The Defendant’s KRW 105,325,828 as well as the Plaintiff’s annual rate of KRW 6% from November 15, 2013 to November 7, 2014.

1. Basic facts

A. On May 13, 2009, the Plaintiff entered into a contract (hereinafter “instant contract”) with the Defendant and Gyeonggi-gun, Gyeonggi-gun, and the Plaintiff on May 13, 2009, setting the construction cost of KRW 7,535,749,00 for the construction work, May 13, 2009, and May 3, 201 (720 days from the date of commencement of the construction work) with respect to the D Corporation, the main purpose of which is to expand and pack the Gun roads of KRW 3.43 km in total at KRW 3.43 km in total (hereinafter “instant construction work”).

B. After the commencement of the instant construction project, the Plaintiff and the Defendant concluded eight-time modification contracts under which the contract amount is modified and the construction period is extended due to the change of design, suspension of the same construction period, etc. as indicated below (hereinafter “each of the instant modification contracts”).

C. Pursuant to each of the instant amendments, the instant construction was completed on June 12, 2013, after 771 days from May 3, 2011, which was the scheduled date for completion of the original construction of the instant construction project.

The Plaintiff and the Defendant completed the completion inspection of the instant construction work on or around June 2013, and the Plaintiff on July 2013.
