1. Defendant A shall be punished by imprisonment for two years.

However, the above sentence shall be executed for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. Defendant A

A. The Defendant violated the Trademark Act, which was imported from the Defendant Company B operated by the Defendant in Busan Sho-gu, with the iron plate, cut off the Switzerland leasing cos, which is the product of the TISD, and tried to arbitrarily indicate and sell the well-known trademark of another company.

On June 11, 2012, the Defendant, at the above B office, demanded L to mark the “POSCO” trademark registered under No. 958105, on the iron plate cuted by entrusting L with the cutting work of the Switzerland 'TISD' Co., Ltd.' on the steco, imported from China.

Therefore, the defendant indicated and sold the "POSCO" trademark in Chapter 7, which is a total of 6,327,813 won of the market price.

In addition, during the period from June 13, 2013 to June 13, 2013, the Defendant used the trademark "POSCO", "OUUPU" registered under No. 872917 with the designated goods as meats, and "THSSSNN trademark" and "APPPPPMNN trademark" registered under No. 291203 using the designated goods as steel plates, etc. and designated goods registered under No. 1083497 with the total market price indicated "APM" trademark 1,620,325,799 won, and 435,4939,436,45,469, the trademark right of "THPSNN trademark" and "APPPM" registered under No. 1083497, the total market price of the goods.

B. The Defendant violated the Unfair Competition Prevention and Trade Secret Protection Act, as described in paragraph (1), sold goods identical to those of another person’s trademark widely known in the Republic of Korea by selling 435,483 km lease 1,629 km in total in the market price marked with the "POSCO", "OUKU", "THYSSEN" and "APERM" on the scrap metal market imported in China, as described in paragraph (1).
