A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant operated C, a cargo transport company, from January 2, 2012 to August 2013, and D, a cargo transport company, from January 2013 to August 2013, respectively.

The Trucking Transport Business Act does not allow the replacement (referring to replacement of a vehicle for trucking transport business) of a special-use truck or a general-use truck in which the supply of a special-use truck is restricted by a public notice of the standards for supply of trucking transport services, and shall report the replacement of a truck to the Trucking Transport Business Association of each City/Do.

1. The Defendant, without filing a report with the Korea Trucking Trucking Transport Business Association, attempted to carry out trucking transport business by forging documents in the name of the said Association, with the intention of increasing the number of special-use type trucks or ordinary trucks, the supply of which is restricted by forging documents in the name of the said Association.

On or around June 10, 2013, the Defendant: (a) at C office located in Gwangju Mine-gu, Gwangju; (b) on the notification of change in the matters permitted for trucking transport business; (c) on the notification of change in the matters permitted for trucking transport business by using a computer, the name of the reported person (owner); (d) vehicle number F; and (e) automobile model: 11.5 tons of freight: large freight, type: general freight, chassis number: 197; (g); (d) total weight (k) : 11500: 2260; (d) total weight (kg): 2220; (d) large freight and automobile model: 11.5 tons of freight: Large freight and automobile type: Special use; (d) Special purpose type; (d): H: 1: Annual discretion: 2080; and (k) maximum discretion (k) 940k: 90k; and (g) 2601.361 of the Enforcement Decree of the Truck Trucking Transport Business Act.
