1. The Defendant’s KRW 63,038,845 as well as the Plaintiff’s KRW 5% per annum from March 18, 2014 to May 26, 2016.
Reasons
1. Occurrence of liability for damages;
(a)The following facts of recognition do not conflict between the Parties, or may be found in the entries or videos of Gap evidence Nos. 1, 2, and 15 (including paper numbers; hereinafter the same shall apply) and Eul evidence Nos. 1 and 4 by integrating the purpose of the entire pleadings:
(1) On March 18, 2014, the Defendant driven a Csch Rexroth motor vehicle (hereinafter “instant motor vehicle”) on the 15:30th day of March 15, 2014, and driven along the 1st line road in front of the Shinmo-si, Busan, to the 3, 4th day of the Mamo-ro apartment in front of the Newmo-gu, Busan (hereinafter “instant vehicle”) along the intersection (hereinafter “instant intersection”), and brought the left turn to the Mamo-si apartment at the Mamo-si (hereinafter “instant intersection”), while the Defendant brought the collision between the Plaintiff’s driver’s Dwork and the front left side of the instant vehicle at the 3,4th side of the Mamo-si, the Plaintiff suffered damage to the 5th day of the Mamo-si and the 5th day of the instant vehicle (hereinafter “instant accident”).
(2) At the time of the instant accident, the instant intersection did not have a signal and did not have traffic control by any other means. However, the Newmoman Industrial Complex apartment road, which intended to turn to the left of the instant car, is a narrow channel, and the width is narrow, and the road where the Plaintiff’s taxi was directly in the Plaintiff’s taxi constitutes a road with a wider width.
B. (1) According to the facts of recognition of the basis for liability, the Defendant is liable to compensate the Plaintiff for damages arising from the instant accident, unless there are special circumstances, as a operator of the instant passenger vehicle.
(2) The limitation of liability is limited, but it is well examined whether there is a vehicle seeking to turn to the left from opposite parts while driving along the instant cross-road while driving along a taxi.
