1. The Defendant’s KRW 1,500,000 as well as the Plaintiff’s annual rate from August 8, 2013 to March 13, 2014.

Reasons

1. Basic facts

A. On June 9, 2009, the Defendant completed the registration of ownership transfer on the ground of sale due to voluntary auction with respect to the land of 4169 square meters (hereinafter “land before subdivision”).

B. On September 19, 2009, the Defendant entered into a contract with the Plaintiff to sell 92 square meters of land (hereinafter “instant land” in attached Form 1 of 300 square meters; hereinafter “instant contract”) among the land before subdivision of KRW 10,50,000 (hereinafter “the instant contract”) and entered into a special agreement with the Plaintiff that “61 square meters of land shall be treated under mutual consultation after the partition survey.”

In addition, the defendant concluded a civil engineering contract on the land of this case between the plaintiff and the same day, and the main contents are as follows.

Article 1 (Prohibition of Rent) The buyer shall pay the seller for the costs of land civil engineering works as follows:

The Defendant, based on the annexed Form 1, requested a boundary survey on the land before subdivision to the site surveying and designing branch office based on the annexed Form 1, received a provisional partition by annexed Form 2 from the site surveying and designing branch office, and again requested a boundary survey to the Korea Cadastral Construction Corporation branch office based on the annexed Form 2 provisional partition, and received a divisional survey drawing (No. 1-4) from the Korea Cadastral Construction Corporation’s branch office.
