Punishment of the crime

1. The summary of the facts charged is that Defendant A was a man who was entrusted with the fostering Ma, etc. of the Korean marina Association E farm in Jeju, which is located in Jeju, with the fostering Ma, etc. from each other, and Defendant B was donated by Defendant A with “F (F)” as he was bred by Defendant A.

A. Defendant A donated the said horses to Defendant B in around 2009, and managed the said horses at the I farm operated by Defendant A in Jeju by being entrusted management of the said horses by Defendant B.

A On August 11, 2011, Defendant B arranged a sales contract to sell the said horses to J for KRW 30 million, and recommended Defendant B, who is registered as a producer in the Republic of Korea, to purchase the livestock disaster insurance by using the support of 50% insurance premium from the victim agricultural and fishery food department, to maintain ownership registration and purchase the livestock disaster insurance with Defendant B, who is registered as a producer, and Defendant B accepted this.

Accordingly, even though Defendant B sold the said horses to the J, on August 12, 2011, Defendant B, upon purchasing the livestock disaster insurance (insurance contractor and the insured: Defendant B, from August 12, 2011 to August 12, 2012: the amount of insurance coverage: KRW 30 million) with respect to the horses owned by the producer, had a public official in charge of the victimized person pay KRW 1,761,00,00,000 for the insurance premium of the said horses to the Agricultural Cooperative Non-Life Insurance Co., Ltd. on the same day.

As a result, the Defendants conspired to acquire the above 1,761,00 won property interest.

B. On September 2, 2011, Defendant A’s fraud of fraud of Defendant A’s insurance money has been artificially created in Korea Marina 12, 201, which is located in Jeju-si managed by the Defendant.
