A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On April 28, 2016, the Defendant filed a complaint with the North Korean Police Station located in the Busan Northern City, Busan, which was located in 63, on April 28, 2016, on the part of the Defendant: “D around November 2015, 2015, the Defendant continued to urge the complainant (Defendant) to go to the her mother and continued to go to the her mother, and, if refusing the D’s request, it would be difficult to live in a place of work, and only view and gather the film by entering the her mother and going to the her mother, which was later than one month, around December 2015.”

On April 29, 2016, the Defendant stated to the police officer in charge that “On November 2015, 2015, the Defendant was forced to leave the clothes of the complainant (Defendant) at the Mosel, kid the Masck and put them into the negative part of the complainant, and then inserted the Masck’s sexual organ into the Masck of the complainant (Defendant). At the end of December 2015, the Defendant made a statement to the effect that, upon receiving the witness’s investigation, D was forced to get off her sexual organ from the Masck to the Masck of the complainant’s arms and forced to put them into the negative part of the complainant’s body.”

However, on November 30, 2015, the Defendant had sexual intercourse with D in agreement with the Furher in Busan Northern area E, and then had attempted to sexual intercourse with D on December 2, 2015 at Hurher located in Busan Northern area, but it was impossible for D to have sexual intercourse with D because D’s father and descendant came to contact with D, and there was no fact that D had been forced rape or attempted to rape by force by exercising assault or force.

Accordingly, the defendant reported false facts as above for the purpose of having D receive criminal punishment.
