1. As to Defendant B’s KRW 258,00,000 and KRW 33,000 among them, Defendant B shall be from October 24, 2003, and KRW 40,000,00.
Reasons
1. Basic facts
A. The Defendants’ relations 1) Defendant B lent KRW 150,00,000 to D on August 3, 199 as interest rate of KRW 2,00,000 per month, and D lent KRW 150,00,000 to E on the same day at maturity of November 3, 1999, KRW 3,90,000 for interest. 2) On August 4, 1999, E lent Defendant B a provisional registration of ownership transfer registration for one-two shares out of KRW 174,248,00 for F forest land in Ansan-gu, Ansan-si (hereinafter “instant share”).
3) On September 12, 2001, D transferred the above loan claims against Defendant B, and Defendant B transferred the total amount of KRW 175,500,000 (3,900,000 x 45 months x 45 months) out of the above loan claims against E acquired from D on May 7, 2003 to Defendant C. Defendant C filed a lawsuit against Defendant C seeking payment of the interest claim that was acquired as above with the Seoul District Court’s Dong branch court’s 2003Gahap4349, and the judgment was rendered in favor of all on September 4, 2003, and the above judgment became final and conclusive as is.
B. On October 24, 2003, the Plaintiff concluded a sales contract with Defendant B for the following terms (hereinafter “instant sales contract”).
(1) On the same day, Defendant C and E accepted KRW 150,000,000 out of the above judgment amount liability against Defendant C and E, and concluded a contract to assume the obligation to pay the remainder by November 25, 2003 (hereinafter “instant contract to assume the obligation”) with the content that the contract shall be paid at the time of the contract and the balance shall be paid by November 25, 2003.
(2) The transfer and acquisition of a right to a provisional registration: The transfer of the right to a provisional registration of 174,248 square meters for forest land in Ansan-si in Gyeonggi-do is as follows: The transfer of the right to a provisional registration of 174,248 square meters for forest land: the sale price: 180,000 won: 180,000 won: the sale price shall be paid at the time of the contract; 162 million won shall be paid at November 25, 2003; and 6.
