A Imprisonment with prison labor of two years and six months, and Defendant B shall be punished by imprisonment with prison labor of one year.
provided that this ruling has become final and conclusive.
Reasons
Punishment of the crime
1. Defendant A violated the Petroleum and Petroleum Substitute Fuel Business Act (hereinafter “Defendant A”) practically operated H gas stations in Chungcheongnam-si and J gas stations in Chungcheongnam-si, Chungcheongnam-si. From October 25, 2012, Defendant A supplied transit through heavy equipment to be used at the M& construction site of L Co., Ltd. located in Chungcheongnam-si, Chungcheongnam-si, and N supplied transit via heavy equipment under employment of Defendant A as a representative of the above J gas station in the name of the above J gas station, and C worked as an employee at the above H gas station.
While no one may manufacture, import, store, transport, store, sell fake petroleum products, or sell fake petroleum products, Defendant A intended to sell fake petroleum products mixed with light oil with light oil in violation of a contract entered into with L Co., Ltd. to supply transit to used heavy equipment at the site of M new construction. From January 1, 2013 to June 2, 2013, in collusion with N andO, an employee, and during the period from January 2, 2013 to June 2, 2013,O loaded petroleum products at the above Jju station in two partitions divided into P Mti-Ⅱ mobile oil vehicles and Q Mti mobile oil vehicles, and 1,000 liters of light oil in back, and Defendant A and N loaded each of the above vehicles into a golf course at the site of construction at Chungcheong City, mixing it with the equipment of the above L Co., Ltd., which is a shift, such as the opening, closing, and closing of the above passenger petroleum products.
2. Defendants’ taking property in breach of trust and giving property in breach of trust
A. From November 1, 2012, Defendant B served as the field supervisor of L Company from November 1, 2012, and was in charge of reporting the amount of oil supplied every day from J stations at the new construction site of M as stipulated in paragraph (1) to L Company.

B shall complete oiling at the construction site above on December 13, 2012.
