1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. C was selected as a lessee of the F block G apartment units in the Youngwon E district, such as Young-gu, Suwon-si D, a public rental housing unit constructed and leased by the Korea Land and Housing Corporation (hereinafter “instant apartment unit”).
B. C, upon being selected as a lessee for the apartment of this case, issued a letter of sale of apartment, power of attorney, certificate of transfer, certificate of waiver of right, statement of performance, sales contract, certificate of transaction, certificate of joint and several sureties and certificate of renunciation of inheritance, designation agreement, promissory note with face value, and receipt, signed and sealed each of the above documents for securing the right. The Defendant transferred multiple persons and acquired the above documents for securing the right.
C. (1) On October 18, 201, the Plaintiff agreed to purchase KRW 45,00,000 for premiums (hereinafter “instant contract”) from the Defendant as a broker of H and I to purchase the documents for securing the rights set forth in the said Paragraph (b) from the Defendant (hereinafter “instant contract”).
() On October 17, 201, the Defendant paid KRW 19,600,000 to the Defendant, respectively, and paid KRW 20,400,000 on October 26, 201, and KRW 5,000,00 on November 14, 2011, and the Defendant issued the documents for securing the right to the said Paragraph to the Plaintiff. 2) H and I drafted a receipt that the Defendant received KRW 19,60,000 from the Plaintiff on October 17, 2011, and the Defendant signed the said receipt. The Defendant signed the said receipt, stating that “In the event of a balance, the credit default and the transfer order of the holder of a title deed at the time of a balance, is null and void.”

On November 14, 2014, C entered into a lease agreement with the Korea Land and Housing Corporation to pay KRW 89,000,000 for lease deposit, KRW 620,00 for each month of rent, and KRW 17,800,00 for the term from January 2, 2014 to January 31, 2016. Of the above lease deposit, KRW 26,700,00 for the term of contract, intermediate payment of KRW 26,700 for the term of contract, and the remainder payment of KRW 44,50,000 for the term of occupancy or the term of designation of occupancy from the Plaintiff on November 14, 201.
