A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. The defendant is a person who is engaged in driving a Bran vehicle in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents and the Road Traffic Act;
On January 16, 2019, the Defendant driven the car free of the driver's license without a driver's license on January 21, 2019 and proceeded to turn to the left at the Eth page from the radio wave promotion center.
Since there is a place where traffic is not controlled, there was a duty of care to confirm whether there is a cross-road vehicle by reducing the speed or temporarily suspending the vehicle.
Nevertheless, the Defendant neglected this and got the victim H (23 years old) who was on board the said taxi vehicle by taking the front right part of the G taxi driver's G taxi driver's car, which is driven on the right side from the left side of the running direction of the Defendant, due to his negligence, and caused the victim H (23 years old) to suffer injury, such as salt, tension, etc. of a trend requiring approximately two weeks of medical treatment.
2. The Defendant violated the Special Act on Insurance Fraud Prevention in collusion with the said F (a summary disposition on the same day) at the place specified in the foregoing paragraph (1), and as described in the foregoing paragraph (1), if the Defendant caused a traffic accident while driving a franchise without a driver’s license, it would not be an insurance process. As such, the Defendant’s mother, I (a summary disposition on the same day), who is the mother of the Defendant, conspired to receive the insurance money by filing a false report as if the traffic accident occurred while driving.
In fact, as described in the above paragraph 1, although the defendant was involved in a traffic accident while driving a franchise without a driver's license, the above I, upon the request of the defendant and J, called the employee in charge of the victim K on January 17, 2019 and called the "Yong-gu, Nam-gu, Gwangju around 23:50 on January 16, 2019."
