A defendant shall be punished by imprisonment for three years.
Of the facts charged in the instant case, assault against the victim D is committed.
Reasons
Punishment of the crime
"2015 Highest 3489"
1. On August 24, 2015, around 15:48, the Defendant: (a) opened a door that was not set up at the house of the victim F of the E building No. 423; (b) opened inside the door; and (c) stolen the cell phone at the market price of KRW 1.50,000,000, which was located therein.
2. On August 31, 2015, the Defendant opened a door that was not set up at the victim G house of the above E building No. 412 on August 31, 2015, and entered the inside, and stolen a cell phone at the market price of KRW 60,000 at that place.
3. At around 00:00 on September 1, 2015, the Defendant: (a) destroyed the Defendant’s gate, which was located in the corridor of the building in the above E-building, by means of a verbal 1 emergency vehicle on the market price owned by the victim H; and (b) 2 emergency vehicle on the market price owned by the victim F.
4. At around 03:35 on September 3, 2015, the Defendant: (a) cut off a half wall containing one cash of KRW 400,000,000,000,000,000,000 won, driving license, resident registration certificate, national bank cream card, agricultural bank cash card, and one house key, which the victim C left to the chair at the J coffee shop located in Gui-si I.
5. On September 5, 2015, around 02:26, the Defendant: (a) destroyed the victim’s L market value owned by the Defendant, which is the resident of the said E-building, by means of a 1,000 square meters on, and on September 5, 2015, the new launch site located in the corridor of the said E-building; (b) caused the victim’s 1,000 square meters on, and 1,000 won on, an emergency exit.
The defendant of "2015 Highest 3679" is the children of the victim M(n, 59 years of age).
At around 17:10 on September 17, 2015, the Defendant: (a) requested the victim D to “the thief case’s agreement amounting to KRW 2 million; (b) the victim D was unable to comply with the request; (c) the victim D’s inside and outside of the victim D due to drinking and launchings, and (d) tried to have two knife (31cm in length) with a deadly weapon in the kitchen, which was in the kitchen, and to write down the victim D, with the victim D.
