A. The Defendant (Counterclaim Plaintiff) B is 64.2 of each program listed in the separate sheet Nos. 1 and 2.

The Plaintiff is a company established for the purpose of developing and selling software, and as its representative director, Defendant C (hereinafter “Defendant C”) is a company established for the purpose of developing and selling software, and Defendant B serves as its representative director.

나. 피고 B는 2007. 8.경 동물병원용 프로그램 제작ㆍ판매회사인 주식회사 다솜네트웍스에서 함께 근무하였던 D의 의뢰를 받아 2008. 1.경 동물병원 통합관리시스템인 별지 목록 제1항 기재 프로그램(별지 목록 제1 내지 3항 기재 각 프로그램을 이하 ‘이 사건 각 프로그램’이라 하고, 개별적으로는 각 항 순번대로 ‘이 사건 프로그램’이라 칭한다) 및 위 프로그램의 전자차트 기능과 연동되는 이미지 뷰어 기능, 보호자 교육용 툴, 동물병원 경영분석 솔루션, 진료대기실 전용 보호자 알림 프로그램 등의 기능을 제공하는 이 사건 3 프로그램을 제작하여 2008. 2.경 원고에게 이를 납품하였고, 그 후 이 사건 1 프로그램을 동물원용으로 일부 수정ㆍ변경한 통합관리시스템인 이 사건 2 프로그램을 제작하여 원고에게 납품하였다.
